CSC Orders Retoactive Promotion to Sergeant

A Police Officer in Salem City appealed his bypass for promotion to Sergeant with the Civil Service Commission. Civil Serivce initially denied his action and Ms. Sandy appealed on his behalf to the Appellate Division. The Appellate Division found that issues of fact existed and remanded the matter to the Office of Administrative Law for a hearing. The Administrative Law Judge found that the Police Officer was improperly bypassed for a promotion, holding that the bypass was based on retaliatory motives and that the appointing authority did not provide a legitimate business reason for the bypass. The Civil Service Commission adopted the Administrative Law Judge’s determination, finding that the bypass for promotion to the position of Sergeant was not justified. The Commission ordered retroactive promotion to Sergeant, back pay, front pay and attorneys fees.
